Yes, if they do not charge him they will have to release him.
They will also be under a duty of care to protect him so I wouldn't be surprised if a plan was already bring put in place to do just that should they not have the evidence to charge.
The Investigating Police officers remember will not make that decision - the file will go to the Crown prosecutors who will determine if sufficient evidence exists to proceed, if they do, he will be charged and remanded in custody (where new time limits apply... Oh there are so many rules), if not, he will be bailed.
It's sad to say, but I really don't see a happy ending to this right now.
