Hi everyone,

I have been told that I have missed out on maternity pay from my company by one week! I am gutted as they offer more than just statutory and i would have got my 6 weeks pay at 90%!

I am currently due on 15th December but my due date needs to change to 21st or later in order for me to qualify for maternity pay from my company! Do you think that the sonographer would change the date at my 20 week scan on Monday if it hasn't changed itself, or is that asking her to do something really bad ie. forge an official document?

Also, this is the really naughty bit! If I changed the date myself, what are the chances of hr at my company ringing the hospital to double check the dates? HR here are aware that there are only a few days in it and they know that I know that too! Hope this all makes sense and I hope someone can help!

Hi

Your definitely not going to persuade the sonographer to change it as I would think it would be seen as misconduct. You might get lucky and find that it has changed if not I'm not sure if HR have the authority to check the date as they would have to take the MATB1 form as an official document.

Hope you get a more definite answer

You must be gutted! :nope: Are you missing out because you haven't worked at the company for a year? The reason I'm asking is because my HR dept have asked me for my MATB1 from 20 weeks not before?

Me too :-/ It's not the person that does the ultrasound that fills in your MAT B1, it's your midwife. As far as asking her to falsify it, who knows? It's crossed my mind too... I seriously could not exist on statutory SMP...

What a bummer :( Personally I wouldn't risk changing it myself your job could at risk if you do I would think. When I had my 20 week scan there was no mention of dating I think at that stage it becomes unreliable anyway. You can always ask though!

ur midwife will do your matb1 after 21 weeks by about 25 as most places of work need to know by week 25 so u get leave etc. You can ask your mw. What harm can it do to ask her?

I started working here one day after I became pregnant! So, I started here 09/03/2009 and my lmp was 08/09/2009! Buggar! You have to have been working for 26 continuous weeks before the 15 week before baby is due, so basically you have to have been working for 1 week before you got pregnant!

Ah thats a nightmare!!!
I just phoned my docs to see when I should get my form, the receptionist told me they don't issue it until I'm 26 weeks pregnant...

Pity we all didn't get full maternity pay regardless of how long we've worked for a company

So does it get given to us by hand then from the midwife at the appointment? And do they tae the date from the 20week scan? x

The midwife will give it to you by hand. I got mine at my 25 week appointment as thats when I needed to hand it in to my work.

She took the dates from my notes and whats in my file on the computor system. That is the dates from my 12 week scan. I don''t think they date you at you 20 week scan (correct me if i'm wrong, not 100% on this) as it starts to become unreliable.

I guess you could ask her, depends what kind of relationship you have. I don't think I would ask mine!!

I've worked for my company for 3 years and still only get SMP. Buggers!

Really! I've got my MATB1 and i'm not 26 weeks yet.

To the OP, i gave the receptionist at my GPs a copy of my 20 week scan results and and she filled in the MATB1 form and the GP signed it and i got it the same day.

I really feel for you, if your employer wasnt aware that you were behind on your dates and you were really brave, then i guess it would have been easy to amend the dates in your scan letter by a few days and get the MATB1 from your GP instead of Midwife and no one would have known.

But as your HR is aware, i really dont think its advisable for you to do that.

Hey, according to gov website MATB1 can be issued anytime after 20 weeks (I checked today coz I'm sorting out my mat leave).

Your due date isn't altered by your 20 week scan, apparently 12-14 wks is the most accurate time for dating so even though my due date would have gone back 2 days from 20 week scan it stays the same. I think it would be pretty unusual for your baby to be measuring a whole week behind your 12 week scan anyway.

So sorry you're missing out on your Mat pay, I really feel for you, I reckon if I could get round I would try!!

i work in a GP surgery and i know in my work the midwifes or docs don't normally do them until 26 weeks give or take a week.

You could ask her explaining, but in all honesty i don't think they will change it for you.. you could try saying to her your due date is... and tell her the date you need and she might just put that on the form without checking and if there is any come back just say it was an error?

I feel really sorry for you and other woman who wont get the benefits of full pay etc when off. I am lucky, i have been with my work for 9 years i get 3 months full pay, 6 weeks pay at 95% and then a further 6 weeks at 85%, so i really don't notice a huge dip in my wages at all.

Good luck xxx

OMG elainegee, you have A fabby employer! At my work is SMP only, no matter how long you have been there :(.

i work in the NHS and my manager told me that my matb1 form has to get to HR before 25 weeks, my next midwife appointment isnt until im 26 weeks so i called the surgery and they said i can jus pop in and pick it up which is what i did at 20 weeks. so i sorted my maternity leave this week, ive got a month of annual leave to use so im taking 2 weeks at the beigning and 2 weeks at the end of my maternity leave. i get 8 weeks full pay and 18 weeks half pay plus SMP! only works out that im losing about 50 quid so not too bad once i get child beneift and tax credit sorted xx

It cant do any harm to ask your midwife (try saying its getting you stressed :winkwink:)
I just picked up my Matb1 form and it has my original due date on it, the one based on last period. The due date i got at my 1st scan and the one we are now going by is nearly 1 week earlier than this. oops. but hopefully means that the exact date dosent matter. Hope my boss dosent complain though as i,m due on the 5 november so think she might remember te date lol
Good luck
