I havn't told my employer im pregnant. I was only 4 weeks at interview so i didn't think it was worth mentioning at that point.

I got the job and my start date is the first week of august. At which point I will be 12 weeks.

Where do I stand legally now with regards to probation period. Can they refuse to continue my employment after the probation because of the pregnancy?

Also, my 2nd day of induction clashes with my 12 week scan, i would have to miss the last 2 hours of the 9 hour day.... I have tried to re arrange my appointment but the hosiptal are being most unhelpful.

I am telling them on Monday that I am pregnant before I start so that they are fully aware and I dont turn up blurting out the news on my first day in august.

I feel really bad as I wasnt expecting to be pregnant when I applied for the job but by the interview I knew I was.

They are a large employer and its for a brand new store thay are opening. also by the time I come to take maternity leave I will have been working there exactly 6 months, just in time for them to pay maternity pay (i think they are going to think I planned it )

Anyone have any advice/experience of this?

Thanks

You have to have been there 6 months by your 25th week of pregnancy in order to qualify for SMP. You will only qualify for MA, which you would qualify for if you had been employed continuously by any employer (even if it is 5 different ones) and paying NICs for the 26 weeks before due date.

Anyone have any advice/experience of this?

I don't have any advice as I am in a kind of similar predicament, although not pregnant yet. I start a new job either mid August or mid Sept, depending on if they can get me through before my holiday or not.

You can't do anything about it. You are pregnant now and all you can do is tell them and hope they aren't going to be idiots about it.

Thanks - im actually glad that they wont be responsible for the maternity pay and I can claim MA anyway so thats not a problem. I've been worried they might think I planned it to get them to pay my maternity but since thats not the case thats good In a way.

Hopefully it will work out but im worried about it all and stressing out!

Employers don't actually pay your SMP anyway - the government pay it. I was a payroll clerk so know this for certain. Your employer pays it and then claims it back; and this is why some companies have maternity benefits of their own on top of SMP, and also how companies can afford to pay your replacement for 6-9 months.

Maternity Allowance is 123.06 per week or 90% of your weekly wage, whichever is the lowest, for 39 weeks (although you don't have to take all 39 weeks off). The difference with SMP is that you can get 90% of your weekly salary for the first 6 weeks and then 123.06 thereafter.

I am worried as well, but slightly different in that I am not yet pregnant! Try not to let this spoil what should be a lovely time for you and your partner.x

Technocly (sp?) they cant refuse to continue your contract after the probation period because your pregnant but that doesnt stop them finding another reason and blaming that instead. Im also pretty sure they have to let you go to scans/antenatal appointments and they have to pay you for it aswell.

Pregnant women are pretty well protected in the workplace but some employers are dodgy and just work around the rules. Hopefully yours will be nice about it.

Oh also you dont have to tell them your pregnant until your 25 weeks so they cant be annoyed you havnt told them already

I agree, hopefully your employer will be decent about it, but legally pregnant women are very well protected in employment law. xx
