Redundancy while on maternity

Hi guys, just wanted some info if possible! Basically the shop I work at may be closing down, it hasn't been confirmed completely but there's the possibility.

Anyway I'm due to start my maternity next week but taking hols first and I will have been with the company 2 years exactly on may 24th, if I was to be made redundant will I be entitled to any redundancy pay?

I've been made redundant before but I'd worked for the company for 4 years so recieved a months wage (1 week for every year) would I qualify this time having only worked 2 years or maybe just under. The business isn't going, just possibility of this shop!

I was made redundant whilst on maternity leave in June, so I'm hoping this info is right and hasn't changed too much in that time!

If you're made redundant on or after the date where you have been there for 2 years, you'll still get a weeks pay for each year you've worked there i.e. 2 weeks worth based on your usual salary. You should also be entitled to the statutory maternity pay which you are entitled to as you were entitled to it on the date of redundancy. Your employer will work out if you're owed any annual leave and should pay you the equivalent if owed. Anything else kind of depends on whether your employer has any enhanced provisions in place, like some places will give some extra as a sweetener.

Oh, and you should also get your pay for your notice period so if your contract says they should give you 2 weeks notice before terminating your employment, they will need to pay you 2 weeks worth of your standard pay as well.
 
That's great thank you :) its not set in stone but it's a shop run by 2 ppl and I'm one do sounds like a possibility. xx

Im due to go on maternity leave in July...for some reason I have it in my mind that I may be made redundant whilst on leave (i know the business is struggling and making cuts)

I'm aware of my rights and that my employer have to offer me another role etc.

However if i end up taking redundanct is my reading of the situation as follows

1- Statutory Redundancy Pay - Based on working for the company 9 years (worked out this would be £3010)

2- Any accrued holiday due (obv this would be worked out at the time

3-Any SMP that I still havre remaining

4-Notice Period Pay - My contract states that to terminate my contract my employer must give me a weeks notice pay for every year i have worked...Ive been there 9 years so 9 weeks? Is this at my full pay before going on leave.

Also ive read that any left over SMP can be dedcuted from the notice period pay?

Is that correct.

Thanks...I am planning well ahead, this may not even happen but want to know we will survive money wise if it did.


Also....I only intend on taking 6 months OML but should I tell my employer this or leave my options open (they assume ill take full 52weeks) if i return after 6 months can they refuse my early return to work??
