returning to work need advice

so i returned to work after a year off -i work for mc donalds not the best company in the world at all
i transferd to a nearer store to my new house to do part time

i keep getting a 2-10 on a monday and 9-5 tue
the 2-10 is killing me,up at 8 if not earlier (630) today with LO then look after LO untill 130 when my mum gets back from work to come get him then i go off to work

i've asked twice for earlier shifts but they said they need more ppl to work at night i even offered a 12-8 anything is better than the shift i'm on atm im shattered before i even start work!

my only major pissed off issue with all of this is that all the other mums get the day shifts and even students and what not but yet i keep being knocked back
not sure if it's cause im new or what


so just wondered what are my rights
i know im entitled to flexable working but what about in this case
 
I would speak to citizens advice bureau and look on the direct.gov website. They need to have a sound reason for declining the flex working!

there reason is that
"we dont need day shift people we need more people to do nights"

not sure if its me being a diva but surely if thats the case they should get the students etc to work the night till 10pm saying as they don't have children or might not even have to be up the next morn!
with me having LO i kinda feel entitled to a day shift not sure if thats right or not?
all the other mums get day shifts but its a no too me :/
 
I don't think they can give you preferential shifts over anyone else, but they equally can't give you all the dregs no one else will do. But I'm not sure what you can really do about it as obviously it wouldn't be hard for them to prove they do need more people in the evening than during the day.
 
Hi there.

Legally you have the right to have an application for flexible working considered once every 12 months. This doesn't mean they have to grant it, although as the PP said they have to have a good reason not to.

However, it sounds as though they do have a good reason, if business needs are for night workers and they already have enough day workers, then that sounds reasonable. They can't force someone else to move to nights to allow you to work days, regardless of whether you have a child or not. It might be worth asking about the possibility of being at the front of the queue to move to a day shift when one of the day workers leaves or moves?

i dont think a 2-10 is unreasonable tbh, i only think you would have grounds for a complaint if they were making you work nights

its more no-one really wants to work the night shift

i've spoken to some of the staff and they said if they had known i'd rather do an earlier shift they would have swapped with me

so i can't really understand why one day a week someone else can do the 2-10 and i do one that lets me finish a little earlier and starts earlier there are people from what i've spoken too that wouldnt mind it because its always dead on a monday but i can't swap shifts every monday x
