SMP / Maternity Allowence - HELP - need someone in the know!!!!

Grrr - Sent my MATB1 form in to my employer (I've only been there since Aug) they emailed me last week to say I wouldn't get SMP?

I'm really confused as I thought I would get it - Can someone pls look at my dates etc and tell me the reasons why I won't get it.....

Baby Due 12.04.2012
First day of Mat Leave 16.03.2012

Started current employment 16.08.2012

Before which my employment at a diff company was From 10.01.2005 - 30.06.2011 so I had a 7 week unemployed gap.

Here's my dates etc from direct gov...

The week that inc the date expect to have baby: 08/04 – 14/04
First day of test period: 02 Jan 2011
Last Day of test period: 07 Apr 2012
The 15th week before the week your baby is due starts on: 25 Dec 2011

I'm wondering if I say I want my mat leave to start on 8th April that I'll get it as its the day after my test period or am I completely off the mark?

Someone pls help - going out my nut thinking I'll get nowt :cry:

I've been on their website most of the night and can't make head nor tail of it - its so confusing :(
 
I think maybe speak to your HR or speak to CAB see if they can help or acas are good for things like this.

They are correct, you have not worked for them long enough to get smp, you would have to have started there in mid July. You should be entitled to maternity allowance from the government though and maternity leave without pay from your work.

Ah thanks x if I told them i wanted my mat leave to start on my due date would that make a diff? x
 
No its nothing to do with when you want to start your leave, its based on the due date of your baby.

I think it works out that you have to have been employed by the same employer for 2 weeks before the baby was concieved. So you wouldn't qualify was SMP. But you may be eligable for maternity allowance.
 
as above you haven't worked there long enough. You needed to of started 2 weeks before you conceived at least. However based on what you have said you will get ma. You need to get the forms from the job centre or you can print from the web site. You needa smp1 from your employer to say that they wont be paying you sma. You still get 39 weeks paid and you can still take the extra 3 months unpaid and you dont have to pay it back if you dont go back. You will still accrue holiday why your off. x
 
Fingers x'd I still get MA - started filling in the form and shall get the ma1 from work soon.....thanks for all your help xx
