Redundancy while pregnant UK

I've just found out that i'm going to be made redundant and I'm pregnant. My employer doesn't know I'm pregnant yet.

I went on the government's maternity leave calculator and based on my current due date, I'm entitled to start maternity leave from the last day of work before I get made redundant. I'm going to change the dates here but as an example: I'm going to be redundant from the 28th of July, so I'm still classed as employed on the 27th, which is the first Sunday which Im allowed to start maternity leave.

My company's maternity package is slightly better than SMP, giving me in total an extra £1500 - not a huge sum, but considering I won't have a job to return to, I want to get what I can.

Do you reckon I can take the redundancy package AND trigger maternity leave for the last day of my contract, thereby getting my full maternity pay from the company as well as redundancy?
 
I think if you get redundancy you can't get company maternity pay as you'll no longer be working there after being made redundant.

If you are made redundant and get a payout though you should be able to get maternity allowance though?
 
Yes you can do this, a colleague did. If you are made redundant during maternity leave they have to pay you all your maternity leave pay even for a time you are no longer working for them, in addition to your redundancy.
 
If you are made redundant on mat leave you should be paid your full statutory maternity pay but any additional contractual enhancement will cease from the date of your dismissal due to redundancy. Will there be any other jobs? You have protected status while pregnant and on mat leave. It's not that they can't make you redundant but if they have suitable alternative employment it should be offered to you without competition. Good luck x
 
I'm not on maternity leave yet, so I'm being made redundant while pregnant. I know that if you're made redundant while already on maternity they have to continue your maternity. I'm trying to work out if I can start mat leave even after having notice of redundancy.

Awaiting contact from my union but that's frustratingly slow. Might end up going to CAB or something soon, dunno why I bothered paying union dues.
 
I think it might depend on your companys redundancy policy. We are going through the same, I find out on the 28th April if after 6 years I am getting to boot. We just get standard redundancy pay.

Will you not know very soon what the outcome is?

There's not really any outcome to find out, in terms of redundancy, because it's happening regardless. there hasn't been a proper consultation, they've just decided it. I can fight that aspect, because they haven't followed correct procedure, but my boss is the kind of person who, if they want me out and are forced to keep me through union action, will make working life hell for me to the point where I quit anyway. I've seen it done to plenty others.

I don't think we have a redundancy policy. My union are being bloody useless and the company aren't sharing all the information they should be with them. Starting to feel quite stitched up.

My union says I have no special rights because I'm pregnant, because if they give me special treatment for pregnancy it will be discrimination against the non-pregnant redundancees. So I have no faith in whatever my union tells me now as I think that's a load of crap.
 
Yes that is right. You can be made redundant whilst preg, as its the role not the person that is redundant. Just you cannot be made redundant because you are pregnant.

It will all depend on how many employees they have who are being made redundant, how long it takes etc.

Your best bet would be to call ACAS. If they are not followign procedure it could come back to bite them later!

We are currently going through a large scale redundancy - 7000 globally, 39 where I work, me being one of 4, of which 2 will go :(.
They have to tread very very carefully on matters of discrimination as if they do it and it breachs any of the acts then you can take them to a tribunal.
I am not holding out much hope as I have performance disciplining on my profile, because of another colleague stealing my work....................which my team leader and HR said was up to ME to resolve..............ludicrous!

But I want to go as I will get a pay out.
 
I dread the thought of taking them to tribunal to be honest, I just want a decent payout, one that reflects the fact that I'm facing redundancy and will be unemployable due to being about 30 weeks pregnant when the contract ends. My union says I haven't a hope of getting that because why should they pay me more than anyone else? Er, because other people can get a new job? Who's going to take me on when pregnant?

I work in a field where the bosses all know one another and if I pee off the one I've got now, they'll just badmouth me to the others and I won't get another job in the area. If I force them to keep me, due to unfair practices, I'll just get bullied out anyway. I've seen it happen to plenty others.

Do you have the option of taking voluntary and negotiating a better payout? That's what I'm hoping for at the moment, just waiting to see if they offer me anything decent for it.
