It's gone past payday and I haven't been paid.
My company has a system whereby everyone with surnames upto M is paid by bank transfer and those with surnames N-Z are paid by cheque, which is paid in by the company. I am paid by cheque and every month am paid on 24th, or if that is not a working day, the closest available day - the latest I have been paid in 11 months with them, is the 25th of the month. It is now 28th, quite late in the day, and no cheque has entered my account... they have 2 working days left to do this, so I won't get cross yet, but I am concerned.
I'm concerned because over the last couple of weeks I have had some problems with this employer, due to them not keeping me safe, them bringing health issues from several years ago into the equation, and then me being signed off 'unwell in pregnancy' because the stress was killing me. Going by the fact they pay cheques in on the closest day available to the 24th, I should have been paid on 23rd (last Friday) or at the latest 26th (Monday). This is only fair, as the cheque will take several days to clear and a lot of people have bills coming out on last or first day of the month. My mortgage actually comes out at the very end of the month, and luckily we have money to cover it.
If they don't pay me, and I have a niggling feeling they are not going to, where do I stand? I have not left this company, and they seemed positively pleased that I was signed off sick as it is less hassle than them sacking me unfairly and they don't have to pay me as the govt pay sick pay. I have done everything by the book. Legal action if they don't pay me?
I should also add that this company had previously left employees unpaid for several months at a time when they have had money worries, without consulting those employees first. This happened last year, and this went on for 2 months, then people got put on short time!
