I have a query re the qualifying week for maternity pay and earnings.

Basally, does it ONLY go on what you were paid? And if you did overtime in that period, that you technically 'earned' but they didnt pay you for until outside of the qualifying period, can you ask this to be included/recalculated?

Basically, I did overtime in December - 2 days and Jan - 2 days. I SHOULD have been paid for these this month but they didnt as the cut off date was the 15th and as they needed the forms physically my boss couldn't sign it till she was back on the 14th Jan.......she sent them and knows they arrived but they didn't pay me, so I will not get this till my Feb pay, on the 21st Feb - which is in my 28th week.

It might not mean much but its an extra £320 before tax that is now not included.
 
According to the DWP website - "It is when you get the money that counts, not when it was earned." So I'm afraid they won't take it into account if it's outside your qualifying period.

As Vesta said, its based on what your avtually paid across the relevant payslips
