It's a horrid thought, but if anything happened to me would my will have any standing in court as to who had day to day care of LO, or does custody automatically go to the other bio parent?
 
I think it goes on what your will says.

If I ever did one, I'd want my parents/partner to have my son over his dad.
 
im thinking about writing a will, i think its a good thing to do and puts ur mind at ease! No way will liams dad be having sole custody if anything ever happened to me! all his family live in london and we live in devon right now and i just know he would take liam and move there and i dont want that! Do you know if it costs anything to write one?
 
Whatever you write in your will goes. If you write that you want your LO to go to your parents that is who they will go to, If you don't write a will the bio father is likely to get them
 
when it comes to custody you will only acts as a way to show your wishes should the worst happen. its not set in stone tht what your will says happens but its a deffo step in the right direction especially if say the grandparents you want to take care of lo has more of a relationship with them than the father does.
 
I have just changed mine and been advised that the will does express my wishes but it is likely that DD's father could contest this very easily and probably win.

But if he loses contact over years etc. (which I am guessing he will) then he will be unlikely to successfully contest the will and my wishes will go.
